These terms apply to your use of the TMSMT Construction website and, unless replaced by a signed contract, to quotations we issue. A signed contract for a specific project takes precedence over these general terms.
Nothing here limits rights you have under South African law, including the Consumer Protection Act, 2008 where it applies.

Quotations
A quotation is valid for the period stated on it. It is based on the scope described and the site conditions visible when it was prepared. Hidden conditions, such as poor ground, concealed services or defective existing work, may require variations.
Variations
Work outside the agreed scope is a variation. We price variations in writing, and they proceed once you approve them.
Payment
Payment stages and due dates are stated in the quotation or contract. Ownership of materials supplied passes on payment. Late payment may allow us to suspend work after written notice.
Access, approvals and compliance
You must give us safe access to the site and, as owner, confirm that you may authorise the work. Where council approval or other consent is needed, building starts only once it is in place, unless agreed in writing. Compliance certificates are issued on completion of the relevant work and after payment of related amounts.
Defects and liability
We rectify defects arising from our workmanship as set out in the agreed defects period or guarantee. We are not liable for damage caused by pre-existing defects, third-party work, misuse, or events outside our control, such as severe weather. To the extent the law permits, our liability is limited to the value of the work concerned.
Governing law
These terms are governed by the laws of the Republic of South Africa. Personal information is handled under our privacy policy.
